By downloading, installing, or using the App, you agree to these Terms of Service. If you do not agree, please do not use the App.
2. Service Description
Team Maker is a free iOS application that allows users to create balanced football teams based on player ratings and attributes. The App stores all data locally on the user's device. There is no backend server, no user accounts, and no online functionality beyond optional iCloud synchronisation provided by Apple.
3. App Usage and Distribution
The App is available exclusively through the Apple App Store. By downloading the App, you also agree to Apple's Licensed Application End User License Agreement (EULA). In case of conflict between these Terms and Apple's EULA, Apple's terms shall prevail with respect to the distribution and licensing of the App through the App Store.
The App is provided free of charge. We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without prior notice.
4. Intellectual Property
All content, design, graphics, logos, and software associated with Team Maker are protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the App or Website without our prior written consent.
The Team Maker name and logo are trademarks of TechSulting. Unauthorised use is prohibited.
5. Limitation of Liability
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, arising out of or in connection with your use of the App.
This limitation does not apply to liability for intentional misconduct or gross negligence, or to any mandatory statutory liability that cannot be excluded or limited under applicable law.
6. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for detailed information on how we handle data in connection with the App and Website.
7. Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. Changes will be published on this page with an updated date. Continued use of the App after changes have been posted constitutes acceptance of the revised terms.
8. Final Provisions
These Terms of Service are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Berlin, Germany.
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
